Terms of Service

These Terms of Service ("Terms") govern your access to and use of BidGovPro, a software product owned and operated by Blue Dog Innovations LLC ("Blue Dog Innovations LLC", "we", "us", or "our"). By purchasing or using BidGovPro, you agree to these Terms. Our order process is conducted by our online reseller and Merchant of Record, FastSpring.

1. License Grant

Upon purchase, you receive a non-exclusive, non-transferable license to use BidGovPro on up to 3 machines associated with your hardware fingerprint. Your license key is tied to your machines and cannot be shared.

2. Permitted Use

You may use BidGovPro for your own business purposes, including finding, analyzing, and bidding on government contracts. You may not resell, redistribute, or reverse engineer the software.

3. Prohibited Activities

You may not: (a) share or publish your license key; (b) attempt to bypass the license validation or feature gating; (c) use the software to engage in fraud or illegal activities; (d) use the software to submit false or fraudulent bids.

4. Not Legal Advice

BidGovPro is decision-support software. Compliance checks, bid analyses, and AI-generated content are informational only and do not constitute legal advice. You are responsible for verifying all information before submitting a bid.

5. Your API Keys & Costs

You are responsible for obtaining and paying for your own SAM.gov, OpenAI/Claude, and Manus API keys. BidGovPro does not include API costs. You are responsible for all charges incurred through your API keys.

6. Refunds

We offer a full refund within 14 days of purchase for any reason, as described in our Refund Policy. Refunds are processed through FastSpring, our Merchant of Record.

7. Disclaimer of Warranty

BidGovPro is provided "as is" and "as available" without warranty of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee any specific result, including that you will identify, win, retain, or successfully perform any contract. Government contracting outcomes depend on factors outside our control — including your submissions, agency decisions, competitors, bid protests, and your own performance. AI-generated content, analyses, and scores may contain errors; you use the software and its outputs at your own risk and must review and verify everything before relying on it or submitting a bid.

8. Assumption of Risk & Sole Responsibility

You are solely responsible for all decisions to pursue, bid on, accept, or perform any contract, and for the accuracy, completeness, and compliance of every submission you make. BidGovPro is decision-support software only and does not act on your behalf. Any reliance on its analyses, scores, compliance checks, or AI-generated content is at your sole discretion and risk. You assume full responsibility for the outcome of any contract, including any contract that is not awarded, is protested, is terminated, or that you are unable to perform for any reason.

9. Limitation of Liability

To the maximum extent permitted by law, our total aggregate liability arising out of or relating to BidGovPro or these Terms shall not exceed the purchase price you paid for your license. We are not liable for lost, unawarded, protested, or terminated contracts, missed deadlines, lost profits or revenue, loss of goodwill, or any indirect, incidental, special, consequential, or punitive damages, even if advised of the possibility of such damages. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless Blue Dog Innovations LLC, together with its owners, officers, employees, and affiliates, from and against any and all claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of BidGovPro; your bids, proposals, or contracts; your performance or non-performance of any contract; or your violation of these Terms or any applicable law or regulation.

11. Governing Law & Venue

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-law rules. You agree that any dispute arising out of or relating to BidGovPro or these Terms shall be resolved exclusively in the state or federal courts located in Colorado, and you consent to the personal jurisdiction of those courts.

12. Severability & Entire Agreement

If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Blue Dog Innovations LLC regarding BidGovPro and supersede any prior agreements.

13. Updates

Free updates are included for one year from purchase. After that, an optional annual upgrade plan is available. Your existing version will continue to work regardless of update eligibility.
